F1 Grand Prix VIP Experience Sweepstakes Official Rules

Eligibility:

1. The F1 Grand Prix VIP Experience Sweepstakes (the "Sweepstakes") is open to legal residents of the United States of America, and who are at least 18 years of age at the time of entry.
2. Employees of MCI, its affiliates, subsidiaries, advertising and promotion agencies, and their immediate family members and/or those living in the same household of each are not eligible to participate in the Sweepstakes.
3. Participants must be representatives of a real company.
4. Void where prohibited by law.
5. All applicable federal, state, provincial and local laws apply.

Sweepstakes Period:

1. The Sweepstakes begins on October 17th 2023 at 12:00 AM [EST] and ends on April 20th, 2024 at 11:59 PM [EST] (the "Sweepstakes Period").

How to Enter:

1. No purchase or payment is necessary to enter or win. A purchase will not increase your chances of winning.
2. During the Sweepstakes Period, participants may enter by visiting flycx.ai and submitting a contact form.
3. All entries must be received by  April 20th, 2024 at 11:59 PM [EST].
4. Limit one (1) entry per person.

Prizes:

Prize includes a VIP trip to an upcoming Miami Grand Prix event, May 3rd - 5th, and fly in a private jet sponsored by MCI. Airfare and ticket to the event are included for the winner and a guest of their choice. Winner is responsible for all costs and expenses not set forth herein, as well as any federal, state, provincial and/or local taxes imposed as a result of acceptance of Prize. Prize is non-transferable and no substitution of any Prize is offered, except at the sole discretion of the Sponsor. By accepting a Prize - except where legally prohibited - you grant permission for Sponsor and its designees to use your name, address (city and state), photograph, voice, and/or other likeness and prize information for advertising, trade, and promotional purposes relating to this Sweepstakes, without further compensation, in all media now known or hereafter discovered, worldwide in perpetuity, without notice or review or approval. 

Odds:

Odds to win depend on the number of eligible entries for the Drawing Period.

Winner Selection & Notification:

1. The potential winner will be notified by email or other contact information provided in their entry.
2. The potential winner must respond within [5] business days of the first attempt to contact them.
3. If the potential winner does not respond within the specified timeframe, the prize may be forfeited, and an alternate winner will be selected.

Prize Award:

All entries are subject to verification prior to awarding the Prize. Sponsor is not responsible for lost, late, misdirected or stolen mail. Lack of response and acceptance of the trip will result in forfeiture of the award and will be awarded to an alternate entrant.

General Terms:

1. By participating, entrants agree to be bound by these Official Rules and the decisions of MCI, LC.
2. Sponsor reserves the right to verify eligibility and compliance with these Official Rules. The VIP trip is non-transferable and no substitution by winners or cash equivalent is allowed. All taxes and other expenses, costs or fees associated with the acceptance and/or use of the Gift Card are the responsibility of the winners.
3. The Sweepstakes is subject to all applicable laws and regulations and is void where prohibited.
4. The Sponsor reserves the right to cancel, suspend, or modify the Sweepstakes if fraud or technical failures compromise the integrity of the Sweepstakes.
5. The Sponsor is not responsible for any typographical or other errors in the offer or administration of the Sweepstakes.
6. All federal, state, and local taxes related to the prize are the sole responsibility of the winner.

Additional Rules:

1. Entry materials/data that have been tampered with or altered are void. No responsibility is assumed for: (i) lost, late, misdirected, damaged, garbled, incomplete or illegible entries, all of which are void; (ii) error, omission, interruption, deletion, defect, delay in operations or transmission, theft or destruction or unauthorized access to or alterations of entry materials, or for technical, network, telephone equipment, electronic, mobile device, computer, hardware or software malfunctions of any kind, or inaccurate transmission of or failure to receive entry information by Sponsor on account of technical problems; or (iii) any injury or damage to entrant's or any other person's mobile device or computer related to or resulting from participating in the VIP FlyCX. The date and time of entry receipt shall be determined by the official clock on the website. Submitted materials become the sole property of Sponsor and will not be acknowledged or returned.

ANY ATTEMPT TO DELIBERATELY DAMAGE THE WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF VIP FlyCX MAY BE IN VIOLATION OF CRIMINAL AND CIVIL LAWS. SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK REMEDIES AND DAMAGES (INCLUDING ATTORNEYS’ FEES) TO THE FULLEST EXTENT OF THE LAW.

By participating, you (i) agree to be bound by these Official Rules, including all eligibility requirements, and (ii) agree to be bound by the decisions of the Sponsor, MCI and the Administrator, which are final and binding in all matters relating to the Sweepstakes. Failure to comply with these Official Rules may result in disqualification from the FlyCX experience. Sponsor reserves the right to: (i) permanently disqualify from any Sweepstakes it sponsors any person it believes has intentionally violated these Official Rules; and (ii) suspend, modify or terminate the VIP FlyCX if Sponsor believes, in its sole discretion, that malfunction, error, disruption or damage is impairing or will impair the administration, security, fairness, integrity or proper conduct of the experience. If the VIP FlyCX is terminated before the end date, Sponsor will determine the winner from all eligible entries received as of the termination date.

Release and Limitations of Liability:

1. By participating, you release and hold harmless the Sponsor, MCI and the Administrator, and their parent companies, subsidiaries, affiliates, partners, employees, directors, agents, advertising agencies, and all others associated with the development and execution of this VIP FlyCX from any and against any and all injury, loss or damage caused or claimed to be caused by your participation in the VIP FlyCX and/or the acceptance, awarding, receipt, use and/or misuse of the prize, and you agree that these entities are not responsible for any warranty, representation, or guarantee, expressed or implied, in fact or in law, relating to VIP FlyCX and/or the awarding of any prize except as expressly provided in these Official Rules. By participating, you agree that: (i) any and all disputes, claims, and causes of action arising out of or in connection with VIP FlyCX, or any prizes awarded, shall be resolved individually without resort to any form of class action; (ii) any claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering theVIP FlyCX, but in no event attorneys’ fees; (iii) under no circumstances will any entrant be permitted to obtain any award for, and entrant hereby waives all rights to claim, punitive, incidental or consequential damages and any and all rights to have damages multiplied or otherwise increased and any other damages, other than damages for actual out-of-pocket expenses; and (iv) these Official Rules and all disputes shall be governed by the internal laws of the state of Florida; without regard to principles of conflicts of laws, any disputes shall be resolved exclusively in the state or federal courts in the state of Florida, and you expressly consent to the jurisdiction of said courts and waive any objection thereto. For New Jersey residents: Nothing herein prohibits recovery of damages or attorneys’ fees where required by statute.

Privacy:

Personal information you submit in connection with VIP FlyCX will be collected, used and disclosed only for the purposes of administering the VIP FlyCX Experience, prize fulfillment, or as you otherwise expressly consent or as required by law. Personal information may be stored on servers in the United States and/or Canada and therefore may be subject to the laws and authority of other jurisdictions. By entering VIP FlyCX, you consent to such collection, use and disclosure. 

OPT-OUT from VIP FlyCX: After completing the Survey, if you wish to be removed from the entry list and decline the chance to win a Prize, please email Catrina.rodgers@mci.world and include: VIP FlyCX Opt-Out in the subject line and your first and last name and email address in the body of the email.

Force Majeure:

1. The failure of Sponsor or Administrator to comply with any provision of these Official Rules due to an act of God, hurricane, war, fire, riot, earthquake, terrorism, national or global health crisis, act of public enemies, actions of governmental authorities — outside of their control (excepting compliance with applicable codes and regulations) — or any other cause beyond their reasonable control, whether similar or dissimilar to any cause listed herein, will not be considered a breach of these Official Rules.
